The tenancy law that came into force on the 1st of August 2008 contains a regulation on overdue maintenance and other defects to the leased property. This defect regulation obliges the landlord to remedy (all) defects to the leased property. Rent law also gives the tenant a number of tools to enforce it. For example, if there is a defect, which causes the tenant to have reduced rental enjoyment, the tenant has the option of claiming a reduction in the rent.
Subdistrict court proceedings
With medium-sized business premises, in a number of cases, both the tenant and the landlord can ask the court to further determine the rent, if it does not correspond to that of comparable business premises on site. Prior to this, the parties should seek advice on this matter from the business rent advisory committee or another expert such as a property valuer. If the parties cannot subsequently reach a settlement, each of them can initiate proceedings in the subdistrict court.« Back to huurrecht
